Isn't every content copyrighted by definition, so this would apply to all content others have produced, or did I miss something here.

Bigger than the EU "bureaucracy" those guys can fine a site out of business for failing to comply with their rules.

Most porn tubes aren't based in Europe.

The claim that "pre-1924 works are in the public domain" is correct only for published works; unpublished works are under federal copyright for at least the life of the author plus 70 years.

so porn pre-1924 is in public domain

It just might seriously hamper the internet. Besides porn think facebook, youtube, twitter, etc. There are some exemptions but they seem to be the usual educational and private storage/share.

How the fuck is the little guy supposed to come up with the infrastructure to preemptively check for possible copyright infringements? This shit is damn near impossible and expensive for the big guys. Everyday shit gets a little more impossible to keep the sites operating within semi confines of the laws. Now I guess California is looking at doing something a kin to the EU GDPR by 2020. Wonderful...

if your site isn't located in EU, then are you exempt? i thought it only applied to EU sites, and EU content ... sites hosted non-EU should be unaffected?

I'm not sure. If the money is right and someone in the EU was violated, I'm guessing they'll come sue me in the USA. So short of a miracle I should be okay. I didn't dig into this and I'm too disgusted to care.

The fact that we have all the big social sites and tubes in America probably had nothing to do with the Europeans looking to go after them
