You can pass laws to retroactively make a crime that did not exist in the past?alex_delevit wrote: ↑May 24th, 2024, 12:34 pmCheck out this article from a May 9, 2024 - the copyright claim statute was changed and the damages can be recovered whenever! There used to be a 3 year statute, meaning that if you posted something over 3 years ago, you would be safe if it was not yet reported. Now, you're never safe. If you're not properly complying with the DMCA, you'd better start if you want to keep owning your website!

Example scenario: Someone steals your car on Monday and you come home from vacation on Thursday to find out that your car was stolen. Imagine that the statute of limitations for reporting that theft is 24 hours from when the theft happened, and you are no longer legally allowed to report it or recover your car. Was your car stolen? Of course, but unfortunately for you, the law says you can no longer recover your car, because your statute of limitations expired and the car is not yours anymore. The changed law would simply allow you to report the theft when you choose to report the theft. I think we can all agree that just because someone else decided to take your car without your permission, your car never stopped being yours.

So the law is making people spend money "According to the law, website operators must register a DMCA Designated Agent with the U.S. Copyright Office to receive immunity from third-party copyright infringement claims under Section 512 of the DMCA."
That sucks

Webmasters are not the ones stealing content (usually...).
If your site allows users to post content, like this blog for example. If I wanted to I can post a stolen picture and Butcher would be liable to deal with it.
The $6 to the Copyright Office gives you 3 Years of Safe Harbor protection.
You still need to actually process and comply with the DMCA notices to receive the protection.
We are releasing a platform soon that includes the Safe Harbor protection and provides a simple Interface to manage and comply with DMCA notices and even automates your compliance.
No need for manual, error prone, time wasting nonsense.
If you're receiving less than 5 notices per month it's only $5 per month.
1 skipped Starbucks coffee gives you 1 month of peace of mind. No brainer.
