Important! Changes to Copyright Law that can effect you!
Check out this article from a May 9, 2024 - the copyright claim statute was changed and the damages can be recovered whenever! There used to be a 3 year statute, meaning that if you posted something over 3 years ago, you would be safe if it was not yet reported. Now, you're never safe. If you're not properly complying with the DMCA, you'd better start if you want to keep owning your website!

There are statues of limitations for just about every crime including rape and copyright gets a pass, you have to love the legal system.

is this sufficient to comply, even though the content comes from my sponsor program free content they put out for affiliates to use, if I get a take down notice I remove the content no questions ask?

If their documentation is true and accurate that seems a reasonable enough defense but I am no attorney.

As long as you are already in compliance and have a registered DMCA Agent, then yes. For most situations with most content owners in the adult industry, you're ok.

Is a registered DMCA agent necessary as long as you post your email and a po box address to have people send you any take down notices?alex_delevit wrote: ↑May 28th, 2024, 12:52 pmAs long as you are already in compliance and have a registered DMCA Agent, then yes. Non-legal layman's opinion no it is not, you have a dmca page or link on your site with a legit contact name and address it is enough.Affman wrote: ↑May 29th, 2024, 8:10 amIs a registered DMCA agent necessary as long as you post your email and a po box address to have people send you any take down notices?alex_delevit wrote: ↑May 28th, 2024, 12:52 pmAs long as you are already in compliance and have a registered DMCA Agent, then yes. Lol, it's not what I think that is important. There are laws on the books, see bottom of this response. For example, there are many places you're not supposed to park your car, but you won't always get a ticket for parking in those places. When it comes to the DMCA, it's simply not worth the risk because the cost of compliance is many orders of magnitude smaller than the lowest potential cost of non-compliance.
If you don't receive any DMCA notices, spend the $6 and register with the US CO for the next 3 years - cheap and simple. If you already have a public business address, you're good to go!
If you receive DMCA notices, or want to keep your address and other information private, or you just don't want to deal with it, there is nothing better than delevit, and I'm not just saying that because it's my company - happy to help anyone who agrees and happy to speak to anyone who disagrees - I guarantee we will be in agreement after we speak.
According to the law, website operators must register a DMCA Designated Agent with the U.S. Copyright Office to receive immunity from third-party copyright infringement claims under Section 512 of the DMCA. This is required if a company's website, app, or other online service allows users to post or store copyrightable material. The registered agent is the person or company that copyright holders can contact if they believe copyrighted material is on a website, and they receive DMCA "takedown notices" that demand the removal of infringing content.

Australia does not have DMCA, there are however Copyright laws in place. I'm not familiar with the intricacies though. You may not need a registered Agent in australia, but removing infringing content seems like an easier path than potentially getting sued or having your website disabled... Copyright laws are international
