Every week when I put the trash out some guy comes along on his bicycle at 5-6am goes through the bins we have a recycle bin for cans plastics and bottles and one for general trash, he looks for cans and plastic bottles, he does this all around the neighbourhood, he claims he cut his finger on an empty can because it was dark outside wants to know if I will give him money so he does not sue me, can he sue me.

Sure he can sue you, anyone can sue anyone. Here is how it works, you need the money to hire a lawyer, the money to file the law suit, a valid case or else you will lose in court. Plus collect any award you may potentially win. I throw all bottles in the recycle bin, I have no patience to collect them go to the store get the 10 cents a pop or whatever it is hell with that. My understanding is people should not be going through your trash period, it is private property if it is inside your property line.

If he came up to me said he cut his finger on an empty can in the dark I would have said great, glad it happened I hope you get an infection and lose your finger, next time don't go sticking your hand in other people's garbage bin. The odds are he won't sue you since he is broke otherwise why would he be out there before dawn going through bins to collect cans. If he does the odds are no judge will side with him, you put the trash out to be picked up. You did nothing wrong, he was not supposed to be in your bin without your consent.

The other thing is when bins are by the curb anyone can throw a can in it,what if a passer by put a snake in it, who is to say it was your can.


That's how I see it, not a lawyer and not giving you legal advice just my personal opinion. I would not worry about it to be honest.

He is wrong going into your bin but if he cuts himself a lawyer will include you in the law suit, will a judge say you are responsible I have no idea.

How can you live off that,at 10 cents you said he has to collect 1000 cans for $100, it is not enough to live on for more than a day. Why not go find a job at any pay make more.

I know and feel for them, what I do not get is why the pan handlers come out in droves by grocery store entrances at Christmas and Easter, what happens the other days do they have choices or are some just exploiting the seasonal good will of others. I'll never forget 2 years ago i was walking into a super market this 40ish looking woman had a sign in her hand with a message to the effect of. Need money to eat. So I gave her $5. As I was walking away she turned the sign around with another message, donate for Ukraine. I thought the balls on this woman, you're begging in the cold for money to eat and after I give you some money you expect me to give you more for a war effort. Like get a life don't do this, you're going to make others who honestly are at the end of the rope and have to ask for food money look bad. The odds of her sending that money to Ukraine were zero, she was playing on peoples' sympathy.

It is not his bin or property so he should not have been in your bin.
