Hi just a dumb newb question but asking here any way. I found a ,net of a big site which is on the .com of same name,can I register it or will the dot com site owner sue me.

Depends who owns the dot com and if it is trade marked and what type of site you put on the .net. If he is using it for a tube and you put a pet food store on the .net it might fly.

Why build your site or brand on a dot net if the3 dot com is already in use, that is not smart.

I bring up the example of the Apple label from Beatles vs. Apple computers. The two came to blows briefly during the 80's, the settled that Apple computers could have their brand as long as they didn't do music. When it came time for the iPod and iTunes, Apple computers had to go back to the table.

So if I registered PornHub.Auto I'd have a good position if all my website was just hubcaps and rims, but the moment I put naked people on there, I would have no ground to stand on.

Also keep in mind, just because you're right, doesn't mean you can't be sued. Best to play it smart.
