Trade and service marks to my understanding are yours if you protect them.chilli.domains wrote: ↑September 21st, 2023, 8:48 amI like your comment about SMHeidiHoe wrote: ↑September 20th, 2023, 10:47 pmThat's the way I understood it as well. You're free to use TM or SM but not R unless you actually register it. SM isn't recommended for use in porn for obvious reasons.gotonudecom wrote: ↑September 20th, 2023, 8:55 pmYou do not need a TM from the Government to be trademarked.
You just need to enforce the Trademark
The TM documentation makes it easier.
Unless the laws have changed. which is possible, but I dont care.
I can still use the TM..![]()

If anyone can put TM on their site what is the point if it has not been registered.gotonudecom wrote: ↑September 20th, 2023, 8:55 pmYou do not need a TM from the Government to be trademarked.

I know he will say get one, cause then he makes money, the government makes money and it is easier to protect.
However, getting one for a domain name is not that easy or cheap. and not really necessary with other laws and case law.

I am not an attorney at law nor giving legal advice, just quoting what I found online,
https://www.mekiplaw.com/trademark-symbols-explained/
"You can use “TM” for goods or “SM” for services. After you have registered your trademark, you can use an ® with the trademark (regardless of whether you sell goods or services)."
They do Trade Mark fillings for $1,395 plus government fees
