Webmasters - How do you handle DMCA Notices?

#1

Post by alex_delevit » March 28th, 2024, 2:32 pm

Hey everyone, hope you're all doing great! As a company that sends DMCA notices on behalf of creators, I always wondered what the process of receiving these notices looks like for the Webmasters. Please shed some light from your experience:

How many notices do you receive?
What is your process if the notice is legitimate?
What is your process if the notice is false?
How much time/money do you spend per infringing link to resolve the issue?
Do you have a DMCA Agent or handle notices internally?
Does your platform host user-uploaded content?
Do you verify the users who post to your platform?

If you can share any other insights, would love to learn that as well!

Thank you everyone!

My content comes from my sponsors and what I have paid for so I ignore the dmca emails.

That's a risky approach... Do you guys at least have a registered Agent on file? It's $6 paid to the copyright office once every 3 years and provides you with "Safe Harbor" protection.

Anyone here who actually complies with DMCA Notices? Would love to learn about your process

Do sites such as Yahoo that link to adult stories or sites with adult content need a DMCA agent?

Yes. Every website that operates in the United States is required by law to have a DMCA Agent. Not having one is just dumb because it is only $6 for 3 years to register with the copyright office and you will have Safe Harbor protection, without this registration you are always at risk of getting sued for 10s or 100s of thousands or more. Chance of getting sued are low, but why risk it if it's only $6 to protect yourself for 3 years.

So the $6 every 3 years is the filing fee the DMCA agent will obviously charge the real fee for being on file.

You can put yourself or one of your buddies for free if you want. The downside of putting yourself is it's public information, the DMCA Agents provide privacy to start with and help with reviewing incoming legal DMCA notices and will run you between $60/year to as much as $300/mo - huge delta in the marketplace for some reason.

As awesome as this topi is, is there anyone here who actually complies with the law and does not put themselves in unnecessary risk who can shed some light on their process?

Not sure if you realize this, but each link in those requests that was reported to you and you ignored is worth up to $150k if any of those people decide to sue. And your registrar, hosting provider, Ad network, payment processor and any other provider you work with will be required by law to release your complete personal information. I highly recommend revisiting this part of your business...

Out of curiosity, how many requests do you receive monthly? Is it too many to deal with?
