First of all anyone can sue anyone, whether they have a case that goes to trial and if they will win the judgment is another story, that said there are various scenarios where you can lose the domain and even be liable for damages, never register a trade marked name, that is a no brainer.

One more thing when it comes to law suits it usually comes down to who has deeper pockets and can spend on a legal team. You might have a half ass case but if you do not have the money to last the case then you might as well not bother suing.

Dont register a well known trade marked name as they are likely to come after you
But other than that, like Butcher says its a a case if they can be bothered and have the money to sue you. For example, we have got tacamateurs.com, tacamateurs.co.uk, tacamateurs.net etc but some bastard has gone and registered tacamateurs.cn (china). We're simply not going to bother with it, not worth the hasstle

Here are 2 examples I can think of.If they have a lesbian porn blog and you start a straight site I can not see what the problem is. If you get sponsorchat.cn and start an adult webmaster forum I can see an issue.
