[NON-BUSINESS] DMCA email threatening to sue me
I have a DMCA email threatening to sue me for an image that is not on my site, what do I do email them back to say it is not on my site and never has been or leave it alone, I do not want to get sued and end up paying for an attorney for nothing.

I am not a lawyer nor pretend to be one but from what I understand a DMCA notice must include the url of the copyright material they want taken down, the copyright holders or his/her agents signature, it can be served electronically or by physical mail. There could be more conditions I am only sure of these two.
If you say the content was never on your site then they have no leg to stand on, ignore it is what I would do. There are a lot of bogus DMCA notices sent out by idiots. Think of it this way if you are not pregnant why would you care to find out the sex of the unborn child, it is a moot point.

Butcher is spot on. Real DMCA notices are much more than just a single email saying "hEy YoU sToLe My CoNtEnT". This sounds awfully fishy. Tell them to piss off.TheButcher wrote: ↑December 8th, 2021, 9:27 amI am not a lawyer nor pretend to be one but from what I understand a DMCA notice must include the url of the copyright material they want taken down, the copyright holders or his/her agents signature, it can be served electronically or by physical mail.

Getting some email like that the first time must be nerve rattling but I guess you soon realize there are so many fake dmca emails being sent and you get used to it.

There's been a bunch of these fake emails going round recently.
We've been through this process a couple of times over the years and there's a few things Ive learned from our lawyers
Firstly, in order for them to sue you they have to be able to demonstrate a "measurable loss". That means they must be able to show that you displaying their content cost them X dollars in lost revenue, and they need to be able to say X is. They cant just pluck a figure out of the air, the court will want to see how they have arrived at that figure.
Secondly any DMCA notice has to give you a "reasonable" period in which to respond or remove the content. Typically 5-7 working days in considered adequate.
And finally, as you say the content was never on your site in the first place then you can simply tell them to get lost
